This is an Agreement between HOLIDAY BEST TRAVEL & TOURISM LLC (also known as the “Company”, “We” “Us” or “Holiday Best Gulf” and the User (also known as the “Client”, “Guest” “You” or “Your”).

By availing, using, or accessing the HOLIDAY BEST TRAVEL & TOURISM L.L.C website the www.holidaybest.ae users are considered to have thoroughly read, comprehended, and explicitly agreed to abide by the terms and conditions outlined in this User Agreement. This agreement governs all intended transactions or service provisions by HOLIDAY BEST TRAVEL & TOURISM L.L.C, and it holds binding significance for the user. Any rights and responsibilities concerning the services offered by HOLIDAY BEST TRAVEL & TOURISM L.L.C are limited to the provisions within this User Agreement.

In conjunction with this User Agreement, HOLIDAY BEST TRAVEL & TOURISM L.L.C may have specific terms of service pertaining to the services it provides. These TERMS OF SERVICE will be supplied or updated by HOLIDAY BEST TRAVEL & TOURISM L.L.C and are considered an integral part of this User Agreement. In the event of any conflict between these TERMS OF SERVICE and the User Agreement, the terms of the User Agreement shall take precedence.

To avail of the services, the User must read and accept the relevant TERMS OF SERVICE associated with the specific service being utilized. Furthermore, certain features or services, such as boat tours, safaris, etc., may be subject to additional rules, regulations, policies, laws, and guidelines. It is the User's responsibility to ensure compliance with these rules, regulations, policies, laws, and guidelines governing the particular features or services being accessed.

HOLIDAY BEST TRAVEL & TOURISM L.L.C provides its services to the User under the condition that the User accepts, without any alterations, all the terms, conditions, and notices stated in this User Agreement and the applicable TERMS OF SERVICE, which may be updated periodically. By using the website, the User acknowledges and accepts this User Agreement and the TERMS OF SERVICE, with complete consent and without any form of pressure or influence.

If the User disagrees with any part of the mentioned terms, conditions, and notices, they must refrain from availing, using, or accessing the HOLIDAY BEST TRAVEL & TOURISM L.L.C website. In the event of any conflict between the terms, conditions, and notices in this User Agreement and those in any other HOLIDAY BEST TRAVEL & TOURISM L.L.C document, the terms of this User Agreement shall prevail.

Please note that we reserve the right to modify this User Agreement without prior notice. It is the User's responsibility to review this User Agreement periodically to stay informed about any changes. By continuing to use the website after any modifications, the User acknowledges and agrees to be bound by the updated terms and conditions.

General Terms & Conditions

• Infants must be under two years of age on the date of their return flight.
• When we issue hotel vouchers, flight details, or any services, it is crucial to ensure that all the details align with your specific requests.
• In case of any discrepancies or incorrect details, please contact us immediately via phone or email, as changes may not be possible later.
• Excursions or tours booked or paid for during your trip are not part of the package holiday provided by us. Please get in touch with the operator of the excursion or tour for any queries related to the booking.
• We are not liable for the provision of the excursion or tour or for any incidents that occur during its provision by the operator.
• In the event that, in our reasonable judgment or that of the service provider, the behaviour of any member of your party is disruptive, threatening, abusive, or causes inconvenience, danger, damage, distress, or annoyance to others or their property, we reserve the right to terminate your travel arrangements without any liability on our part. No refunds will be provided, and you will be responsible for any expenses or costs resulting from the termination.
• While it is unlikely, circumstances may arise that require alterations to your travel arrangements. In such cases, we reserve the right to make changes to your booking at any time.
• We may cancel a booking if necessary due to events beyond our control or overbooking caused by defaults or omissions of third parties providing services included in the booking. We will inform you of such events as soon as practicable and may offer a refund or a comparable alternative holiday for any cancelled booking at our discretion. In such circumstances, we will have no further liability to you.
• The Company does not directly provide accommodation, ground services, tours, or other activities. We do not control the third parties who offer such services in connection with your holiday.
• We do not accept liability for any injury, illness, death, loss, damage, expense, cost, or other claims resulting from the actions or omissions of the affected individuals or any third parties not involved in providing your arrangements. We are also not liable for events beyond our control.
• Your booking may be serviced by carriers, accommodation providers, car rental companies, catering services, and other parties with their own booking conditions of carriage and business. We have no direct control over these parties, and their booking conditions may limit compensation payable to you. You agree to abide by their booking conditions, available upon request.
• We will not be held responsible for services or facilities not included in our contract with you, such as excursions you book while on your trip or services provided by your hotel or other suppliers. These arrangements are independent of your pre-booked holiday with us, and we have no liability in relation to them.

Pricing

• Our pricing policy guarantees cost-effective rates, coupled with the ease of making seamless online reservations. The prices displayed on our website are applicable per person. Please be aware that the published rates are subject to change without prior notice, especially in the event of unforeseen circumstances, such as fluctuations in airline tickets, hotel rates, or transportation expenses.
• Prices displayed are per person and based on double occupancy, with two adults sharing as outlined in the itinerary.
• We reserve the right to modify the prices of any holiday packages shown on our website or flyers due to dynamic rates.
• Upon booking, you will receive your personalized itinerary and pricing details.
• Additional transfers between cities may be arranged at an extra cost.
• If you have made a booking without completing the full payment, please be aware that the package price is subject to change until the full payment is made.
• Prices shown online may vary from those offered by travel agents.
• Prior to making a booking, we will provide you with the current holiday package, including any additional services you may have requested.
• The price of any booked holiday package covers only the specified items and does not include personal services, travel insurance, visa fees, transit visas, room service, hotel extras (e.g., laundry, early check-in/late check-out charges, gratuities, or taxes).

Methods of Payment

We gladly accept a wide range of major credit cards, including Visa, MasterCard, as well as credit/debit cards in AED and USD currencies. For completing transactions, full payment must be made through a credit card, and guests are required to provide their credit card details. The charge for the transaction will be reflected on your statement.

When making a payment for our products or services on our website, the information you provide will be securely transmitted to our payment provider.

It is essential for the cardholder to retain copies of transaction records, as well as familiarize themselves with the merchant policies and rules.

Payments can be made in cash, through debit or credit cards. Online payments and credit card transactions may be subject to an additional fee, which will be communicated to you.

If, for any reason, we do not accept a booking, any payment made for that booking will be refunded if possible.

Full payment or a deposit is required in advance of booking. Failure to pay the remaining balance may result in the cancellation of your bookings

Confirmation of Payment

After completing the payment, our travel consultants will email you a confirmation slip. You can present this printed confirmation as proof of payment to the service provider when redeeming your tour package. However, please ensure that you have provided accurate information regarding your travel requirements at the time of booking.

Cancellations

• If you or any member of your family decides to cancel the travel arrangements, a written cancellation notice must be provided.
• Failure to cancel in advance may result in a No-show fee in addition to any other penalties imposed by suppliers.
• Please be aware that certain travel arrangements may not be subject to cancellation or amendments once a reservation has been made/confirmed, and any such changes could result in a cancellation charge of up to 100%.

In the event of any cancellation, the following conditions may apply.

• Refunds will be issued only through the Original Mode of Payment.

No Show

• No refunds, either partial or full, can be provided if you fail to attend the tour. The same policy applies to unused tickets, sightseeing tours, car-rental, or chauffeur-driven services.
• Additionally, rescheduling is not permitted for confirmed tours, airport transfers or any other travel related services.

Cancellation Procedures

Before proceeding with a cancellation, we advise you to thoroughly review the cancellation rules that are applicable to your specific tour package. To cancel any or all parts of your reservation, please ensure that you provide a written notification of cancellation to HOLIDAY BEST TRAVEL & TOURISM L.L.C Dubai Tours. Upon receiving your cancellation request, we will promptly respond via email, fax, or telephone to confirm the booking cancellation and inform you of any applicable fees that must be paid.

Please note that HOLIDAY BEST TRAVEL & TOURISM L.L.C cannot be held liable for any cancellations that have not been received from you or have not been confirmed by our team.

Itinerary Amendments

• If you wish to make changes to your travel arrangements, such as altering your check-in date, travel date, departure date, or accommodation, we will make every effort to accommodate your request, but it may not always be possible and may be subject to additional charges.
• All requests for changes must be submitted in writing by the same person who made the booking and must be received within a specific timeframe. An amendment fee will be applied, and you will be required to cover any increase in the cost of your holiday resulting from the changes.
• Please note that certain travel arrangements may not be changeable after a reservation has been made, and any alteration request could lead to a cancellation charge of up to 100%.
• If you wish to make changes to your existing booking, and we can accommodate your request, you will be charged a change fee per person in addition to any applicable rate adjustments or extra costs incurred, as well as any expenses or charges imposed by our suppliers.
• If we make a significant change to your holiday, we will inform you as soon as reasonably possible before your departure. You will have the option to accept the revised arrangements or opt for alternative travel arrangements of comparable standard from us, if available.
• You must inform us of your choice within 7 days of being notified of the major change we are making, or as soon as reasonably practicable if your departure is less than 7 days from the date of notification. Failure to notify us will be deemed as acceptance of the change proposed by us.
• The routings and services included in your package are subject to potential changes due to factors like local conditions, weather, airway schedules, and other relevant aspects. In such cases, we will offer alternative options of similar value, depending on availability. If any changes to the itinerary occur, we will inform you before departure.
• Please be aware that HOLIDAY BEST TRAVEL & TOURISM L.L.C retains the full right to make minor amendments to the itinerary without providing reimbursement. Additionally, no reimbursement can be issued in the event of force majeure circumstances, such as a flood or earthquake.

Hotel Accommodation & Check-in & Check-out Policy

• If your flight arrives early, we recommend booking your accommodation for one night before your arrival so that you can be assured of a ready room.
• Similarly, if your flight departs late and you wish to extend your stay at the hotel, we advise you to book an extended stay at the time of making the initial booking to make the most of the hotel facilities until your departure.
• We cannot guarantee requests such as connecting rooms, rooms on the same floor, specific room numbers, or bed types (twin beds/king beds). In such cases, compensation will not be provided.
• If a son/daughter shares a room with two adults, the hotel may provide 'existing bedding' without an additional bed as standard. However, rollaway beds/sofa beds can often be arranged at an additional charge. Some rooms may not accommodate more than two adults.
• If we are unable to trace accommodation at your preferred hotel, we will make every effort to offer you a suitable alternative with a similar budget and standard. Regarding the check-in and check-out policy, it varies based on the specific hotel you have chosen.
• Please note that HOLIDAY BEST TRAVEL & TOURISM L.L.C cannot be held accountable for any early or late check-in and check-out requests that the hotel may not be able to accommodate due to their busy schedule.

Travel Insurance

• HOLIDAY BEST TRAVEL & TOURISM L.L.C shall not be responsible for any damages resulting from accidents, illnesses, injuries, loss of personal belongings, or trip cancellations. We highly recommend that travelers obtain a travel insurance policy to protect against unforeseen circumstances. 
• We strongly recommend that all passengers/customers obtain comprehensive travel and medical insurance suitable for their specific needs prior to traveling. It is your responsibility to ensure that the purchased insurance coverage is appropriate and sufficient for your particular requirements.
• It is advisable to consult your doctor at least six weeks before your travel date to inquire about any overseas health requirements or vaccinations you may need. Certain countries have restrictions on possessing specific prescription drugs, so it's essential to check with your consulate before traveling.
• You are responsible for ensuring that you are physically fit to travel and partake in all aspects of the services you have booked and undertaken.

Travel Documents

• Each guest is responsible for ensuring they possess the necessary documents required for a specific tour, such as a passport or a valid ID card, particularly if they are traveling from a different country. We regret to inform you that no refunds can be provided in case of loss or absence of these essential documents.
• Moreover, passengers of all nationalities are advised to verify entry requirements by contacting their respective country's consulate before planning their visit. It is equally important to inquire with your consulate about current visa and health requirements, as they may change without prior notice.
• It is your responsibility to ensure that your passport is valid for at least 6 months beyond your return date and that it is in good condition with empty pages.
• If you have UAE residence, you must possess a valid resident permit for at least 6 months.
• You must ensure that you have a valid visa before traveling.
• It is advisable to keep copies of all essential travel documents with you.
• Passport, visa, and other immigration requirements are your responsibility, and you should verify these with the relevant Embassies or Consulates. We are not responsible if you are unable to travel due to non-compliance with any passport, visa, or immigration requirements.
• You and all members of your party/family must ensure you have valid passports, visas, vaccination certificates, and any other necessary documents required to enter the countries you are visiting, including transit stops, before your departure. We cannot be held responsible for any failure to comply, leading to costs or fines incurred, and we advise you to check with the relevant passport office(s) or consulate(s) if you have any queries

Website Usage Restrictions

• United Arab of Emirates is our country of domicile.
• Minors under the age of 18 shall be prohibited to register as a User of this website and are not allowed to transact or use the Travel Companies website.
• www.holidaybest .ae / HOLIDAY BEST TRAVEL & TOURISM L.L.C will not deal or provide any services/products to any of OFAC sanctions countries in accordance with the law of UAE.

By visiting the Website and/or making a booking, the User agrees to use the website only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations and generally accepted online practices or guidelines.

Wherein, the User understands, acknowledges and agrees that:

1. In order to use or book through the website www.holidaybest.ae  the User may be required to provide certain information about the User (such as identification, contact details, etc.) as part of the registration process, or as part of the ability of the User to book. The User agrees that any information provided by the User will always be accurate, correct, and up to date;
2. The User shall be responsible for maintaining the confidentiality of any login information associated with any account the User use to access the website. Accordingly, User shall be responsible for all activities that occur under the account/s of the User;
3. By using or accessing the website, the User authorizes HOLIDAY BEST TRAVEL & TOURISM L.L.C and HOLIDAY BEST TRAVEL & TOURISM L.L.C agents to access third party sites, including that of banks and other payment gateways, designated by them or on their behalf for retrieving requested information. The User is fully responsible for all activities that occur while using the login information or the Website. It is the duty of the User to notify HOLIDAY BEST TRAVEL & TOURISM L.L.C immediately in writing of any unauthorized use of the login information or any other breach of security. HOLIDAY BEST TRAVEL & TOURISM L.L.C shall not be liable in any event for any loss that may be incurred by the User as a result of unauthorized use of the login information or the Website either with or without his knowledge. The User shall not use anyone else’s password at any time;
4. The User specifically agrees not to access (or attempt to access) the website HOLIDAY BEST TRAVEL & TOURISM L.L.C through any automated, unethical or unconventional means;
5. Engaging in any activity that disrupts or interferes with HOLIDAY BEST TRAVEL & TOURISM L.L.C website, including the servers and/or networks to which the website is located or connected, is strictly prohibited;
6. The User shall be solely responsible for any consequences, losses, or damages that HOLIDAY BEST TRAVEL & TOURISM L.L.C may directly or indirectly incur or suffer due to any unauthorized activities conducted by the User, including as explained above, and may incur criminal or civil liability;
7. HOLIDAY BEST TRAVEL & TOURISM L.L.C is responsible only for the transactions that are done by the User through HOLIDAY BEST TRAVEL & TOURISM L.L.C. HOLIDAY BEST TRAVEL & TOURISM L.L.C is not responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the applicable laws;
8. The User warrants that the User will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the website. The User further warrants that the User shall comply with all applicable laws and regulations regarding the website;
9. The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the service under the applicable law or by any other law, rule or authority;
10. HOLIDAY BEST TRAVEL & TOURISM L.L.C may send booking confirmation, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the service, via SMS, email or by voice call on the contact number given by the User at the time of booking; HOLIDAY BEST TRAVEL & TOURISM L.L.C may also contact the User by voice call, SMS or email in case the User couldn’t or hasn’t concluded the booking, for any reason whatsoever, to know the preference of the User for concluding the booking and also to help the User for the same. The User hereby unconditionally consents that such communications via SMS, email and/ or voice call by HOLIDAY BEST TRAVEL & TOURISM L.L.C is: (a) upon the request and authorization of the User, (b) ‘transactional’ and not an ‘unsolicited commercial communication’ as per any applicable guidelines under any jurisdiction and (c) in compliance with the relevant guidelines applicable on HOLIDAY BEST TRAVEL & TOURISM L.L.C or the User availing, using or accessing the website and/or service under any jurisdiction. The User will indemnify HOLIDAY BEST TRAVEL & TOURISM L.L.C against all types of losses and damages incurred by HOLIDAY BEST TRAVEL & TOURISM L.L.C due to any action taken by any authority due to any erroneous compliant raised by the User on HOLIDAY BEST TRAVEL & TOURISM L.L.C with respect to the intimations mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever;
11. HOLIDAY BEST TRAVEL & TOURISM L.L.C may provide various open communication tools on the Website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. The User understands that generally HOLIDAY BEST TRAVEL & TOURISM L.L.C do not pre-screen or monitor the content posted by users of these various communication tools, which means that if the User choose to use these tools to submit any type of content to the Website, then it will be personal responsibility of the User to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, the User agree that the User will not upload, post, share, or otherwise distribute any content that:
12. Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;
13. Infringes on any trademark, patent, trade secret, copyright, or other proprietary right of any party;
14. Contains any type of unauthorized or unsolicited advertising;
15. Impersonates any person or entity, including any www.ub-cool .com employees or representatives;
16. HOLIDAY BEST TRAVEL & TOURISM L.L.C have the right at its sole discretion to remove any content that, HOLIDAY BEST TRAVEL & TOURISM L.L.C feel in its judgment does not comply with this User Agreement, along with any content that it may feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. HOLIDAY BEST TRAVEL & TOURISM L.L.C shall not be responsible for any delay or failure in removing such content. If HOLIDAY BEST TRAVEL & TOURISM L.L.C chooses to remove any content posted by the User, User hereby consent to such removal, and further consent to waive any claim against HOLIDAY BEST TRAVEL & TOURISM L.L.C;
17. HOLIDAY BEST TRAVEL & TOURISM L.L.C does not assume any liability for any content posted by the User or any other 3rd party users of the Website. However, any content posted by the User using any open communication tools on the Website, provided that it doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of HOLIDAY BEST TRAVEL & TOURISM L.L.C, and as such, gives HOLIDAY BEST TRAVEL & TOURISM L.L.C a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as HOLIDAY BEST TRAVEL & TOURISM L.L.C deem fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use the website and/or service;
18. The User agrees to indemnify and hold harmless HOLIDAY BEST TRAVEL & TOURISM L.L.C and its parent company and affiliates, and its and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to the account of the User whether incurred by the User or any other person using the account of the User. HOLIDAY BEST TRAVEL & TOURISM L.L.C reserves the right to take over the exclusive defense of any claim for which HOLIDAY BEST TRAVEL & TOURISM L.L.C is entitled to indemnification under this User Agreement. In such event, the User shall provide HOLIDAY BEST TRAVEL & TOURISM L.L.C with such cooperation as is reasonably requested by HOLIDAY BEST TRAVEL & TOURISM L.L.C

Advertisers on the websites or linked websites

HOLIDAY BEST TRAVEL & TOURISM L.L.C shall not be responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages. We do not endorse any advertiser on the Website or web pages in any manner. The Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information. The linked sites are not under the control of HOLIDAY BEST TRAVEL & TOURISM L.L.C and HOLIDAY BEST TRAVEL & TOURISM L.L.C is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. HOLIDAY BEST TRAVEL & TOURISM L.L.C is providing these links to the Users only as a convenience and the inclusion of any link does not imply endorsement of the site by HOLIDAY BEST TRAVEL & TOURISM L.L.C.

Force majeure

We shall not be held liable for changes or cancellations of a holiday due to events beyond our control. Examples of such events include war, riot, political unrest, terrorist activity, industrial disputes, natural disasters, weather conditions, government actions, airport closures, failure of carriers or hoteliers to provide services for any reason.

The customer and/or agency agrees that HOLIDAY BEST TRAVEL & TOURISM L.L.C reserve the right to deviate from the boat’s advertised route if necessary and may cancel or change the day or time of any booking with or without prior notice to the user; in the event of such circumstances replacement trips or refunds may be offered at the discretion of HOLIDAY BEST TRAVEL & TOURISM L.L.C.

Indemnification

The user agrees to indemnify, defend and hold harmless HOLIDAY BEST TRAVEL & TOURISM L.L.C and/or its affiliates, their Websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by HOLIDAY BEST TRAVEL & TOURISM L.L.C and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the customer and/or agency pursuant to this User Agreement. The user shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and HOLIDAY BEST TRAVEL & TOURISM L.L.C cannot be held responsible for the same.
